This month our Planner focus is Children with a Family Member in Prison and Children involved with the Court System.
The National Information Centre on Children of Offenders (NICCO) estimates that approximately 310,000 children have a parent sent to prison each year and that 10,000 children visit public prisons every week.
There is, however, no formal record of who these children are and whether they are receiving support, often meaning that they are hidden and struggling alone.
There can be many barriers to children and young people speaking about having a family member in prison. You may find that children have not been told the true reason why a family member is not around, yet they still have to deal with practical and emotional losses.
In the UK, there are three types of court that children and young people may be involved with: tribunals, the criminal court and the family court (part of the civil court system). However, they are most likely to be involved with the latter two. In both criminal and family courts, the decision rests with someone else, and can lead children and young people to feel they have no control over their future.
The experience of being involved in a court case can differ from one child to the next, regardless of whether they are the victim, the defendant, a witness or are incidentally involved. Involvement with the courts can be stressful and lead to physical and mental ill health. The outcome of court could significantly change the child’s life, for example, they may have to move home, change school, be taken into care, or face a custodial sentence.
Court processes of any kind may cause/entrench conflict within families or groups. Arguments between family members may be witnessed by children and young people.
